Department of Economic Affairs Ministry of Finance, Government of India North Block New Delhi 110001, India Dear Mr. Khare: India: National Aids Control Support Project (Credit No. 5236- IN) Amendment to the Financing Agreement We refer to the Financing Agreement ("Financing Agreement") between India ("Recipient") and the International Development Association ("Association") dated June 18, 2013, as amended for the National Aids Control Support Project. We also refer to your letter no. F.No. 5/6/2011-FB.V dated June 4, 2019, requesting the Association to consider the restructuring of the Project. Accordingly, the Association, after due consideration proposes to amend the above-mentioned agreement as follows: 1. Section 3.01 is hereby amended to read as follows: "The Recipient declares its commitment to the objective of the Project. To this end, the Recipient shall carry out the Project through DAC/NACO, with the assistance of CMSS, and of the SACS at the State level, in accordance with the provisions of Article IV of the General Conditions." 2. The following clause (e) is hereby added to Section I.A.2 of Schedule 2: "(e) cause CMSS to undertake procurement of goods required by DAC/NACO and/or SACS for carrying out the Project, including antiretroviral drugs and test kits." 3. Section I.D of Schedule 2 is hereby amended to read as follows: "The Recipient, through DAC/NACO, shall, or shall cause CMSS, each SACS and each Beneficiary to: 1. carry out the Project in accordance with the GESI and the ICWMP in a manner satisfactory to the Association; and Mr. Sameer Kumar Khare -2- June 26, 2019 2. submit to the Association semi-annual progress reports, as part of the Project Reports, on compliance with social and environmental safeguard measures under the Project, detailing measures taken in furtherance of the GESI and the ICWMP, and of conditions, if any, which interfere or threaten to interfere with the smooth implementation of the GESI and the ICWMP, and remedial measures taken or required to be taken to address such conditions." 4. Section II.B.1 of Schedule 2 is hereby amended to read as follows: "1. The Recipient, through DAC/NACO, shall, and shall cause the SACS and CMSS to, maintain a financial management system in accordance with the provisions of Section 4.09 of the General Conditions." 5. Section IV.A.2(b) of Schedule 2 is hereby amended to read as follows: "the term "operating costs" means incremental costs incurred by DAC/NACO, CMSS and each SACS for the purposes of carrying out the Project, including, office rent and utilities, office and equipment insurance, office maintenance and repair, vehicle maintenance and repair, communication, travel costs and other administrative costs directly associated with, and necessary under, the Project." 6. Section I on Definitions in the Appendix is amended as follows: a. The following definition is added: ""CMSS" means the Central Medical Services Society, established within the Borrower's Ministry of Health and Family Welfare, in order to undertake procurement of health sector goods." b. The terms are renumbered in accordance with the insertion above. 7. The Results Framework agreed further to Section 11.1 of Schedule 2 to the Financing Agreement is revised to read in its entirely as set forth in Attachment I hereto. Except as specifically amended by this Amendment Letter, all other provisions of the Financing Agreements shall remain unchanged and in full force and effect. The Association will disclose this Amendment Letter and related information in accordance with the World Bank's Policy on Access to Information. By entering into this Amendment Letter, the Recipient consents to disclosure of this Amendment Letter and related information.
